These terms govern the use of mindtomarketco.com and form the general conditions of any service provided by MindToMarket LLC. A written proposal or agreement signed with you prevails over these terms where they differ.

1. Who we are
MindToMarket LLC ("MindToMarket", "we") is a limited liability company registered in the State of New Mexico, USA, with its business address at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, USA. Email: info@mindtomarketco.com.
2. Use of the website
You may browse this website for information about our services. You agree not to misuse it: no attempts to gain unauthorised access, no automated mass submissions through the form, no content that is unlawful, abusive or infringes the rights of others. Information on the website is general and may change without notice.
3. Our services
We provide digital marketing and business growth consulting to businesses, such as positioning and offer clarity, messaging and brand direction, audience research, marketing direction, channel and content planning, campaign briefs, growth priorities, and measurement. The specific scope, deliverables, timing and responsibilities of each engagement are set out in a written proposal accepted by you. Formats and scenarios on the website are descriptions and examples, not offers capable of acceptance.
4. Fees and payment
Fees, currency, payment schedule, deposits and any taxes are stated in the written proposal. Third-party costs such as advertising spend, software subscriptions or platform fees, and who pays them, are stated before you commit and are paid by you directly or reimbursed only after your written approval. No fee is due for anything you have not accepted in writing.
5. Your responsibilities
You provide accurate information, timely feedback and the access we reasonably need. You remain responsible for your products, your offers, your prices, the claims you approve for publication and your compliance with the laws and platform rules that apply to your business. Where we work inside your accounts, those accounts remain yours and under your control.
6. Cancellation and refunds
How an engagement may be cancelled, what work has been authorised, how undelivered work and any third-party commitments already approved are treated, and how any amount due or repayable is calculated are set out in the written proposal before work starts. No standard price, deposit or refund schedule applies to this website. Nothing in these terms limits any right you have under consumer law that cannot be waived.
7. No guarantee of results
Sales and marketing results depend on factors outside our control, including your offer, market, budget, competitors and the decisions of platforms and buyers. We perform our services with reasonable skill and care, but we do not guarantee any level of sales, leads, revenue, rankings or return on investment.
8. Intellectual property
Once paid in full, the deliverables created specifically for you belong to you. We keep ownership of our pre-existing materials, methods, templates and know-how, and grant you a non-exclusive licence to use them as part of the deliverables. Unless you object in writing, we may mention that we worked with your company, without disclosing confidential information. The content and design of this website belong to MindToMarket LLC or its licensors.
9. Confidentiality
Each party keeps confidential the non-public information it receives from the other and uses it only for the engagement. The duration of this duty is set out in the written agreement for the engagement.
10. Limitation of liability
To the maximum extent permitted by law, MindToMarket is not liable for indirect or consequential losses, lost profits, lost revenue or lost data. Any further limit on liability is set out in the written agreement for the engagement. Nothing in these terms limits liability that cannot be limited by law, such as fraud or wilful misconduct.
11. Governing law and disputes
These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules, unless the written agreement for an engagement states otherwise. Mandatory law may give you the right to bring a claim elsewhere. If a dispute arises, we ask that you first write to us at info@mindtomarketco.com so that we can try to resolve it in good faith.
12. Changes and contact
We may update these terms; the version published on the date of a proposal applies to that engagement. Questions: info@mindtomarketco.com.
